2.2 Under no circumstances shall it be understood that any licence is granted or that any waiver, transfer, total or partial assignment of said rights is made, nor shall any right or expectation of right be conferred, and in particular, of alteration, exploitation, reproduction, distribution or public communication of said contents without prior express authorisation from AFRICAN AIRS or of the relevant holders.
2.3 No link may be established to the Portal from any other website without the prior and express consent of AFRICAN AIRS.
3. RESPONSIBILITY OF AFRICAN AIRS
3.1 AFRICAN AIRS shall be liable for any damages that the User may suffer as a result of the use of the Portal when such damages are directly attributable to the wilful or negligent actions of this company and the User's actions were not due to fault or negligence. In any case, there shall be no wilful or negligent action on the part of AFRICAN AIRS when he proves that he has complied with the legal and regulatory requirements and other care and diligence required by the nature of the service.

4. OBLIGATIONS OF THE USER
4.1 In general terms, the User undertakes to comply with these General Conditions of Use, and any applicable Special Conditions, as well as to comply with any special warnings or instructions for use contained therein or on the Portal and to act always in accordance with the law, good customs and the requirements of good faith, using the diligence appropriate to the nature of the service he/she enjoys, refraining from using the Portal in any way that may prevent, damage or deteriorate the normal operation of the same, the property or rights of AFRICAN AIRSits suppliers, the rest of the Users or any third party in general.

The communications of AFRICAN AIRS to the User will be carried out in accordance with the data provided by the User when registering on the Portal.
The User expressly accepts, for all communications related to the use of the Portal and/or the contracting of the services offered therein, the use of electronic mail as a valid procedure for sending such communications.

TITLE III: "CONDITIONS FOR THE PROVISION OF SERVICES BETWEEN AIRES AFRICA AND USERS".
1. GENERAL CONTRACTING CONDITIONS. INFORMATION PRIOR TO CONTRACTING
1.1. These general terms and conditions of contract, together with any special conditions that may be established, shall expressly regulate the relations that arise between AIRES AFRICANOS S.L.with registered office in Huelva, Parque Dunar S/N, 21760 Matalascañas, Almonte (Huelva) and with Tax Identification Number: B2155422. AFRICAN AIRS) and third parties (hereinafter "Users") who contract the provision of services or products offered through the Portal.
1.2 These General Conditions have been drawn up in accordance with the provisions of Law 34/2002, on information society services and electronic commerce, Law 7/1998 on General Contracting Conditions, Royal Legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the General Law for the Defence of Consumers and Users and other complementary laws, Law 7/1996 on the Regulation of Retail Trade, Law 59/2003, of 19 December, on Electronic Signatures and any other applicable legal provisions.

1.5 All information provided during the recruitment process will be stored by AFRICAN AIRS so that the User may, upon written request or by e-mail, request information concerning the operations carried out by him/her within the previous 6 months. Any modification and/or correction of the data provided by Users during browsing must be carried out in accordance with the indications included in the Portal.
2. SERVICES OFFERED. ACCESS TO SERVICES
2.1 The Services offered on the Portal shall be governed both by the provisions of these General Conditions and, in particular, by the provisions of the Specific Conditions established for each of these services.
2.2. In order to access the services offered through the Portal, AFRICAN AIRS and/or the contracting company appointed for the collection of such services, may provide the User with a User name and a secret code ("Password"). The User Name and the Password provided by AFRICAN AIRS to the User are identifiers and enabling elements for accessing the services and are of a personal and non-transferable nature. AFRICAN AIRS may, with appropriate prior notice, make changes to the User Name and/or password, in which case the modified passwords shall lose their validity.
2.3. All technical means and requirements necessary to access the Portal and the services offered therein shall be the exclusive responsibility of the User, as well as any expenses or taxes to which the provision of such services may give rise.
2.4. Once accessed, and in order to proceed with the use of the different services, the User must follow all the indications and instructions shown on the screen, filling in the Particular Conditions and other forms established for each service, which will imply the reading and acceptance of all the general conditions established in the General Conditions of Use of the Portal, in these General Contracting Conditions, as well as the Particular Conditions that may be applicable, as the case may be.
