1.1. The Products offered in the Store, together with their characteristics and price will appear on the screen. In those cases in which the price of the products is determined by weight, the price per kilogram or gram will be indicated, although in the latter case the final price that will be included in the proof of purchase will depend on the actual weight of the product.
Likewise, the total shipping costs to the User's address for each order will appear on the screen, which will always be paid by the purchaser. The prices shown on the screen are in euros and include VAT and any other applicable tax and will at all times be those in force. The offers will be duly indicated on the screen. AIRES AFRICANOS, as appropriate, reserves the right to decide at any time, the Products contained and offered to Users through the Store. In this way, AIRES AFRICANOS, may at any time add new products to those included in the Store, it being understood, unless otherwise provided, that such new products will be governed by the provisions of the General Conditions in force at that time. Also AIRES AFRICANOS, reserves the right to stop providing access, at any time and without notice, any of the products offered in the Store.
1.2. For the purchase of products in the Store, AIRES AFRICANOS may ask Users to register or in any case to fill in a form with their contact details, for which said Users, who must be over eighteen (18) years of age, must complete the instructions that appear on the screen and will be required to execute the following instructions, as well as any others that are included in the different screens of the Store:
The User Name and Password provided by AIRES AFRICANOS to the User are elements that identify and enable the User to access and make purchases and are personal and non-transferable.
The User Name cannot be changed by the User but the password cannot be changed by the User, in which case the original passwords will lose their validity.
If the User forgets the password, a new password will be sent to the e-mail address provided in the User's registration.
1.3. It is possible that without registering, or once the User has registered, and in order to proceed with the purchase of Products, he/she must add the product he/she wishes to purchase in the Shopping Basket, according to the indications shown on the screen. Once all the products have been chosen, the delivery date will be validated and the purchase will be accepted, which implies the reading and irrevocable acceptance of each and every one of these General Conditions, as well as, if applicable, of the existing Particular Conditions. The purchase prices will be those in force at the time the order is placed.
The amount of the purchase, at the time of order confirmation, may not coincide with the final amount of the order, due to the existence of products of varying weights on delivery.
1.4. Once the purchase has been made and as soon as possible, always within 24 hours from the execution of the purchase, the AIRES AFRICANOS Customer Service Department will send the user by e-mail a receipt of the purchase made. Likewise, the Customer may request, and AIRES AFRICANOS will send the corresponding invoice. The order confirmation and proof of purchase will not be valid as an invoice.
1.5. AIRES AFRICANOS reserves the right to cancel the User Name and password, and therefore access to the shop of those users who maintain balances owed or unpaid with AIRES AFRICANOS, in addition to not allowing the recruitment of any order to those users who use the portal and make the recruitment of their purchases in bad faith, or breach any of these General Conditions and, where appropriate, of the existing Special Conditions or abuse of the various offers or promotions.
1.6. For any communication of the status, incidents and / or management of the order, AIRES AFRICANOS will contact the user through the various channels available such as telephone, SMS, chat and / or mail, unless otherwise indicated by the user.
2.1 Payment of the price of the goods purchased and the shipping costs, which will appear on the screen, may be made in accordance with the means of payment indicated on the screen at any given time. In order to proceed with the payment, the User must follow each and every one of the instructions that appear on the screen, providing the following information: a) Type of card; b) Card number; c) Expiration date, as well as d) any other information required on the screen.
As an electronic payment system, AIRES AFRICANOS has installed an e-commerce payment gateway. All data provided for this purpose are encrypted to ensure maximum security. They are hosted on a secure server certified according to the SSL protocol. AIRES AFRICANOS also states that under no circumstances store in any way the payment details provided by users through the payment gateway, and that are retained only while the purchase is made, the payment is made and until the withdrawal period has elapsed.
In order to guarantee the greatest security to our customers, AIRES AFRICANOS reserves the right to request the documents corresponding to the identity and means of payment of the User, prior to the delivery of the order.
2.2 In accordance with the provisions of the Consolidated Text of the Law on Consumers and Users, AIRES AFRICANOS will deliver the goods purchased by the User, at the address of the Buyer indicated for this purpose in the order form, within the agreed period and, in any case, always within thirty (30) calendar days from the date of placing the order. The shipping costs for each order shall be borne by the Purchaser.
2.3. The user/consumer may opt for home delivery or collection at a NACEX service member, indicated for this purpose on the order form. Products will not be delivered to post office boxes or public places other than those explicitly offered during the purchase process.
2.4. The delivery time will be as expressly indicated for each product, it always being understood that this delivery time refers to working days, which will be counted from the date of confirmation of the order by AIRES AFRICANOS. Express delivery costs shall also be borne by the Buyer.
2.5. The consumer shall have a period of 15 calendar days to terminate the sale, provided that the nature of the goods purchased so permits. The period of 15 days set out in the preceding paragraph shall be calculated from the receipt by the Buyer of the purchased goods. In any case, it shall be understood that the Purchaser has been aware of the right of withdrawal from the moment of entering the Store, which requires the reading and acceptance of these General Conditions, and in any case from the moment the order is placed. Returns of orders must be processed through the Customer Service Department, in order to arrange for the order to be collected from your home or returned to the hypermarket concerned. AIRES AFRICANOS will refund the amounts received by credit note, but the Buyer will bear the direct costs of returning the goods, as set out in the Consolidated Text of the General Law for the Defence of Consumers and Users, within a period not exceeding 14 calendar days from the date on which we are notified of your decision to withdraw from the contract. In case of return of the goods purchased by the customer, the customer shall bear the cost of collection of the same. These costs shall be equal to the shipping costs applicable to the delivery of the goods. The procedure for making a return is specified in the returns section of the shop at the bottom of the home page. Notwithstanding the foregoing, the right of withdrawal and / or resolution is excluded in cases where, by the very nature of the goods purchased, it is impossible to carry it out, without prejudice to the corresponding claim for damages suffered, as well as in the case of failure to comply with the following conditions:
The goods must be delivered to our carrier in perfect condition, packed in a closed and sealed package covering its original packaging. The product must be perfectly identified and marked with the return number provided by Customer Services.
AIRES AFRICANOS will be liable for the lack of conformity of the products with the contract, repairing or replacing the product under the terms set out in Title IV below. The customer shall bear the direct costs of returning the goods.
If the product arrives in poor condition due to transport, the user must indicate this on the carrier's delivery note and call our Customer Service Department within 24 hours of receipt to make a complaint.

2.6. Information on exercising the right of withdrawal
You have the right to withdraw from this contract within 15 calendar days without giving any reason.
The withdrawal period shall expire 15 calendar days after the day on which you or a third party, other than the carrier and indicated by you, acquired the material possession of the goods.
To exercise your right of withdrawal, you must notify us of your name, your full address and, if available, your telephone number and your e-mail address, your decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post or e-mail) or by calling our customer service department. In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.
In the event of withdrawal by you, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a mode of delivery other than the least expensive mode of standard delivery offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any charges as a result of the reimbursement. We may withhold reimbursement until we have received the goods back, or until you have provided proof of return of the goods, whichever is the earliest.
We will either collect the goods from you or you must return or deliver the goods directly to us at one of our physical points of sale, hypermarkets, without undue delay and in any event not later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if you return the goods before the end of this period.
You will have to bear the direct cost of returning the goods. This cost is estimated to be approximately the cost, in euros, of sending the goods.
You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The price reduction and the rescission of the contract shall be applicable, at the choice of the consumer, where the consumer is unable to require repair or replacement and where the repair or replacement has not been carried out within a reasonable time or without major inconvenience to the consumer. The price reduction shall be in proportion to the difference in value between the value which the goods would have had at the time of delivery, if they had been delivered in accordance with the contract, and the value which the goods actually had at the time of delivery.
